Regulatory Update

Last week, OFS submitted comments as part of DEQ’s second rulemaking to implement the Recycling Modernization Act. This rulemaking in part focused on covered product exemptions. OFS continues to advocate for a more clear exemption for pesticides, fertilizers, and agricultural amendments, as has been granted in other state programs. Many of these products are already exempted based on a statutory exemption for products used on farms. OFS members are also concerned with the ballooning cost projections of Oregon’s program and will be supporting greater legislative oversight as DEQ continues its rulemaking process. The comment period on the second rulemaking has been extended until 4 p.m. on July 26, 2024.
