Local Haulers & Neighbors File Land Use Appeals for Lane County’s New Garbage Processing Site

The County Failed to Notify Neighbors of Zoning Changes and Ignored Numerous Land Use Rules

Eugene, Ore – On September 30, 2024, Jake Pelroy, volunteer president of the Lane County Garbage and Recycling Association (LCGRA) filed 3 reconsideration/appeal challenges to the County Hearings Official’s decision. The appeals from 2 neighbors and LCGRA allege the County’s failure to give proper notice to several affected property owners and interested stakeholders and that the notices they did provide to some owners failed to disclose the County’s intention to pave the way for siting the garbage site. State and County Laws required the County to notify affected property owners and to describe the uses that could be authorized by the decision.  The appeals also specify that the County ignored several important state and County land use laws, including laws protecting natural resources, laws prohibiting new sewer systems outside of urban growth boundaries, laws about not overwhelming transportation systems and several key County Comprehensive Plan provisions, among others.

Jake Pelroy, a spokesman for LCGRA, said in a statement: “Once again, Lane County is not following the law on disclosure and transparency; this is following the Oregon Government Ethics Committee finding Lane County in violation of public meetings laws. The County is well aware that there is tremendous public interest in their plan to site a new garbage site on land composed almost entirely of wetlands. The County is not above the law and illegal shortcuts cannot be used to avoid public scrutiny. The County must hold a proper hearing, on proper notice and apply the rules that apply to everyone.”
