Oregon Recycling Modernization Act update

Last month, Oregon’s Recycling Modernization Act [7] (RMA) went into full effect, requiring that certain companies selling products into Oregon pay fees based on packaging. In some cases, costs are required from those in the supply chain such as distributors and retailers, who are not connected to packaging decisions. On July 30th, the National Association of Wholesaler-Distributors sued the state [8] in US District Court in Portland, asserting that the new law is unconstitutional. The RMA’s costs have ballooned significantly, with expected fees for 2026 far above initial projected costs for this program. Many products and commodities will simply be priced out of the Oregon marketplace because of this. OFS will continue to monitor this program and associated litigation and legislative actions.
