Regulatory Update

For those making a list and checking it twice before heading off for your holiday activities, written comments for ODA’s LUBGWMA fertilizer rulemaking [7] are due at 5pm on Monday, December 22nd. These proposed rules will have a significant impact on producers in the LUB and will set a precedent for other existing and future groundwater management areas. The proposed rules include required soil sampling before nitrogen fertilization, irrigation management, creation of nutrient management plans, record-keeping, and more. OFS remains most concerned about the use of deep soil residual nitrogen testing as a metric for regulatory success, which is reflected in our written comments, submitt [8]ed to [9]day.
